Flawless Victory? Supreme Court Rules in Favor of Violent Video Games

The Supreme Court ruled in a 7-2 decision on Monday to strike down a proposed California law that would have instituted a $1,000 fine on retailers selling violent and sexually charged video games to underage gamers.

"As a means of assisting concerned parents it (the law) is seriously overinclusive because it abridges the First Amendment rights of young people whose parents (and aunts and uncles) think violent video games are a harmless pastime," wrote Justice Antonin Scalia for the majority opinion .

"No doubt a state possesses legitimate power to protect children from harm. But that does not include a free-floating power to restrict the ideas to which children may be exposed."

As for the game publishers, they're understandably thrilled with the decision to leave the choice up to discerning parents. 

"Believe it or not, I do have some confidence left in America and the Constitution," said Vince Desi, CEO of Tucson-based Running with Scissors. "When we lose the freedom of expression, the country is toast. . . But this worked out.

California Lawyers said the "postcard" series as "violent" title that retailers should be prohibited from selling to children.

NEW YORK (CNNMoney) – The Supreme Court has overturned a California law that would have banned the sale of violent games to children – and game publishers could not be happier.

The 7-2 decision on Monday killed the 2005 law, the California legislature that the system said the gaming industry's voluntary classification strong enough.

At that time, California lawyers told the Running With Scissors game "Postal 2". That game follows a character through everyday tasks – with the option to engage in riots murderers.

Vince Desi, CEO of Running with Scissors, is delighted with the ruling of the Supreme Court.

"Believe it or not, I have a little confidence left in the United States and the Constitution," said Desi. "When you lose the freedom of expression, the country is toast. Right now we are in the oven, and sometimes we grill. But it worked."

Freedom of expression was a primary objective of the court's decision. Name of the majority, Justice Antonin Scalia called the law "seriously superinclusivo" and a violation of the rights of the First Amendment.

Desi, whose company is based in Tucson, Arizona, criticized California lawmakers, saying he believed they were working only for political interests and "pretending to be for moral reasons." He also defended "Postal 2" as a game "serves consequences for the killing and is a reflection of real life."

Other video game publishers also clung to the "freedom" idea in his remarks the reaction on Monday.

"Video games have had to face censorship and defend creative freedom" from Electronic Arts ( ERTS ), Said in a statement.

Activision Blizzard ( ATVI ) Head of the official policy of George Rose, whose company publishes the "Call of Duty" series, called the law of California "vague and misinterpreted." He applauded the Supreme Court of the "strength of mind," which he said "leaves little room for interpretation."

Take-Two Interactive – publisher of the popular video game franchise like Grand Theft Auto, Dead Red Redemption and Bioshock – said he was "pleased" with the decision, which "affirms that freedom of artistic expression is protected by our Constitution.
