Carty's attorney tells jurors case is political persecution
ST. THOMAS - As attorneys presented their closing arguments in the trial of three former Schneider Regional Medical Center executives on Thursday, Attorney Anthony Chambers, representing Amos Carty Jr., asked jurors for their undivided attention.
"I have this young man's life in my hands, and I take it very seriously," Chambers said.
Describing the case, he said "The board turncoats are trying to make the defendants into scapegoats."
Chambers said there had been allegations, fabrications and selective memory.
"It's a political persecution, not a prosecution," he said.
Chambers referred to the findings in the 2008 inspectors general audit of the hospital that led to the criminal investigation of the case.
"They really didn't care to find the truth," he said.
Chambers said prosecutors put a "big facade" on documents from the hospital not being available to auditors, but the bottom line was that the hospital could not release the documents until some confidentiality issues had been taken care of.
Chambers also reminded jurors that testimony indicated that his client allowed auditors to view the documents, for as long as they liked. But, Chambers said, Carty could not produce copies of the documents until some legal issues were addressed.
When the draft audit report came out in 2008, Carty put together the hospital's response, which Chambers said addressed every issue that the auditors had raised.
The response went straight to the governor, so it could be considered before the final audit was released, Chambers said.
That response from the hospital was totally ignored, he said.
"Why wouldn't they want to know the truth?" Chambers asked the jury, and suggested that going public with the audit would damage reputations and images in the community.
Carty had aspirations to run for governor, and Chambers has contended throughout the trial that Carty's prosecution is politically motivated.
The hospital board knew about payments over NOPA salary, Chambers said.
He also contended that the board knew all about the contracts that are at issue in the case and about the Clark Consulting reports that are evidence in the case. Testimony has indicated that a 2007 Clark Consulting report contains warnings about Chief Executive Officer Rodney Miller's 2005 contract and the potential liability to the hospital.
"Some of them want to hem and haw, and some of them want to run around, but they can't hide from these Clark Consulting reports," Chambers said.
